We did not initially expand upon this as part of the ML agreement since, as a global community, we would have to encompass thousands of different phrasings and framings to represent a litany of crimes (e.g., "lewd and lascivious acts" in the US vs. "outraging public decency" in the UK; similar crimes, different terminology). For that reason, we still don't believe we can provide a list of specific charges. But we did add the following language to the ML agreement describing categories that we consider disqualifying:
- Abuse, harm, or neglect towards any person of any age, whether mental, emotional, sexual, financial or other
- Violation of any laws or statutes related to the mishandling of funds or property
- Fraud or false representation
- Other harmful or exploitative behaviors relevant to the responsibilities of the position
We recognize that the final one is a bit more vague, but we do believe there are miscellaneous crimes that don't constitute abuse, harm, neglect, fraud, or financial misconduct that we would disqualify (speaking of lewd and lascivious behavior, indecent exposure is a good example of one).
We do want to underscore our belief that charges which are criminalized in some localities (e.g. sexual orientation, other prohibited behavior between consenting adults, homelessness, illegal entry as it relates to immigration) should not be considered crimes and that no one will be disqualified for crimes which, themselves, go against our own policies of inclusion.
We also want to underscore that we really don't care about completely unrelated charges (e.g., traffic violations, jaywalking, minor drug possession, etc.)
